These terms and conditions ("Agreement") set forth the general terms and conditions of your use of the Kakooma mobile application ("Mobile Application" or "Service") and any related products and services (collectively, "Services"). This Agreement is legally binding between you ("User", "you" or "your") and Tang Math Games, LLC ("Tang Math Games, LLC", "we", "us" or "our").
By accessing and using the Mobile Application and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity, in which case the terms "User", "you", or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access or use the Mobile Application and Services.
1. Eligibility
Our Mobile Application is designed for children under 13 years of age. However, we strongly advise that parental review and supervision be provided when children are using the app. Tang Math Games, LLC is not responsible for any harm that may occur directly or indirectly as a result of your child’s use of the Mobile Application and Services. We recommend that parents or legal guardians guide their children’s use of the app.
2. License to Use
Tang Math Games, LLC grants you a non-exclusive, non-transferable, and revocable license to use the Kakooma Mobile Application and Services for personal entertainment purposes, subject to these Terms.
3. Links to Other Resources
Although the Mobile Application and Services may link to other resources such as websites or mobile applications, we are not implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource unless specifically stated. We do not assume responsibility or liability for the actions, products, services, or content of any third parties. You should carefully review the legal statements and other conditions of use of any resource you access through a link in the Mobile Application. Your linking to any off-site resources is at your own risk.
4. Indemnification
You agree to indemnify and hold Tang Math Games, LLC and its affiliates, directors, officers, employees, agents, suppliers, and licensors harmless from any liabilities, losses, damages, or costs, including reasonable attorneys' fees, incurred in connection with or arising from third-party claims or disputes related to your use of the Mobile Application, Services, or any content you submit, or any willful misconduct on your part.
5. Intellectual Property Rights
The Kakooma app and its Services are protected by intellectual property laws. You acknowledge that Tang Math Games, LLC owns all intellectual property rights related to the Mobile Application and Services. These include but are not limited to copyrights, trademarks, and other proprietary rights. This Agreement does not transfer any intellectual property to you, and all rights, titles, and interests in and to such property remain with Tang Math Games, LLC.
6. Accepting the Terms
By accessing and using the Mobile Application and Services, you acknowledge that you have read and understood this Agreement, and agree to be bound by its terms and conditions. If you do not agree to abide by these terms, you are not authorized to access or use the Mobile Application and Services.
7. Parental Review and Supervision
While the Kakooma app is designed to be enjoyable for children under 13 years of age, parental review and supervision are essential to ensure the app is used safely. Tang Math Games, LLC is not responsible for any potential harm caused directly or indirectly to children through the use of the app. It is the responsibility of the parent or legal guardian to monitor the child’s use of the app.
